This page is a plain-English starting point, not a substitute for legal advice. Have a solicitor review these terms before relying on them commercially — especially now that SharpY Mind offers real accounts storing children's profile data, not just the local-only mode.

1. What SharpY Mind is

SharpY Mind is an independent, gamified Maths revision aid for children preparing for UK 11+ entrance exams. It is provided for educational practice purposes only.

2. Not affiliated with any exam board or school

SharpY Mind is not affiliated with, endorsed by, sponsored by, or produced in partnership with Sutton SET, GL Assessment, ISEB, or any school named within the app. Those names are used only to describe the exam format a family may be preparing for and to help the app adapt its question difficulty and topic mix accordingly. Actual exam content, format and syllabus are set solely by each exam board and school, and can change at any time — always confirm current requirements on the relevant school's own admissions page.

3. No guarantee of outcomes

Practising with SharpY Mind does not guarantee any particular exam result, school offer, or outcome. The "exam timing" and "2028+ forecast" content shown in the app is informed general judgement, not fact, and is clearly labelled as such within the app.

4. Who this is for

SharpY Mind is intended to be used by children under the supervision of a parent, guardian, or teacher, who is responsible for reviewing and agreeing to these terms on the child's behalf and for supervising the child's use of the app and any device it runs on. Only an adult may create a Family Account; child profiles exist solely within a parent's own account and cannot be created or controlled independently by a child.

5. Your data stays with you

In local (no-account) mode, SharpY Mind stores all progress only in your browser. You are responsible for backing up and safeguarding that data using the in-app Backup feature; we do not hold a copy and cannot recover lost local progress on your behalf. If you use a Family Account, your data is stored with our database provider as described in our Privacy Policy — see that page for full details of what's collected and how it's protected.

6. Family Accounts and child profiles

You're responsible for your login. Keep your parent account password confidential, and use a password you don't reuse elsewhere. We cannot recover a lost password for you beyond the standard reset-by-email flow, and we are not liable for unauthorised access resulting from a password you've shared or reused.
Child PINs are a convenience, not a security boundary. A 4-digit PIN protects a shared family device from casual sibling access — it is not a substitute for keeping your own device and parent login secure, and should not be treated as equivalent to a real password.
You can reset or remove a child's profile at any time from the Family Dashboard, and sensitive changes (resetting a PIN, unlocking a locked profile, deleting a profile) require re-entering your password.
Locking a profile restricts settings changes for that child until a parent unlocks it — this is a parental control feature, not a guarantee against all possible misuse of a shared device.

7. Acceptable use

Don't attempt to disrupt, reverse-engineer for malicious purposes, or misuse the app in a way that could harm other users.
Don't attempt to access another family's account or child profile, or circumvent the account system's access controls.
The app's content (questions, design, branding) may not be copied or redistributed for commercial resale without permission.

7a. No human interaction, messaging, or user-generated content

SharpY Mind has no chat, messaging, forums, comments, or any other way for a child to communicate with another user, a tutor, or staff, and no feature lets anyone post content visible to other users. Because of this, safeguarding requirements around adult-child contact (e.g. DBS/PVG checks) and the Online Safety Act 2023's duties around user-to-user or search content do not apply to SharpY Mind as it exists today. If either of these ever changes — for example, if a tutoring, messaging, or community feature is added — this section and our safeguarding position will be reviewed and updated before that feature launches.

8. "As is", no warranty

SharpY Mind is provided "as is" and "as available", without warranties of any kind, express or implied, including as to accuracy, fitness for a particular purpose, or uninterrupted availability. Question content is reviewed for accuracy but may occasionally contain errors; please let us know if you spot one.

9. Limitation of liability

To the fullest extent permitted by law, SharpY Mind and its creator are not liable for any indirect, incidental, or consequential loss arising from use of the app, including exam outcomes, lost local or account data, unauthorised account access resulting from a compromised password, or reliance on any forecast or estimate shown in the app.

10. Changes

These terms, and the app itself, may change over time — including the introduction of new features, subjects, or a paid tier in the future. Continued use after a change means you accept the updated terms.

11. Governing law

These terms are governed by the laws of England and Wales, unless you are a consumer resident elsewhere with mandatory local consumer protections that apply regardless.
